Special-category and sensitive information

Recruitment information may in some circumstances contain special-category personal data or other sensitive information, including information relating to health, disability or reasonable adjustments where relevant to a recruitment process.

Where we process special-category personal data, we will do so only where permitted by applicable data-protection law and where an appropriate legal condition for processing applies.

Please do not provide sensitive personal information unless it is relevant to the recruitment process or has been requested.

2. How We Obtain Your Information

We may obtain personal information directly from you when you:

  • apply for an opportunity;

  • submit information through our website;

  • provide us with your CV;

  • contact us by email, telephone or another communication channel;

  • otherwise engage with our services.

Applications or candidate information may also reach us through job boards, recruitment platforms, professional networks or other services through which an opportunity has been advertised.

Proactive candidate sourcing

As part of our recruitment and headhunting activities, we may identify prospective candidates who have not directly applied to AceSuited.

Information may be obtained from publicly available or legitimate professional sources, including:

  • LinkedIn and other professional networking platforms;

  • job boards and recruitment platforms;

  • publicly available professional profiles;

  • referrals and recommendations;

  • clients and recruitment partners; and

  • other legitimate sources relevant to professional recruitment.

This information may be recorded within our recruitment or customer relationship management systems where reasonably necessary for our recruitment activities.

Where we obtain your personal information from another source, we will process it in accordance with applicable data-protection law and provide relevant privacy information within the period required by law.

3. How We Use Your Information

We may process personal information in order to:

  • understand and manage client hiring requirements;

  • develop and maintain relationships with candidates and clients;

  • analyse and improve our services and recruitment processes;

  • protect our systems and prevent fraud, misuse and security incidents;

  • establish, exercise or defend legal claims; and

  • comply with applicable legal, regulatory, accounting and professional obligations.

Because recruitment relationships may continue beyond a particular vacancy, information about suitable candidates may be retained and used to identify relevant future opportunities.

4. Our Lawful Bases for Processing

Under applicable data-protection law, we must have a lawful basis for processing personal information.

Depending upon the circumstances, we may process personal information because:

Contract or steps before entering into a contract
Processing is necessary to take steps at your request before entering into a contract or to perform a contract with you.

Legitimate interests
Processing is necessary for our legitimate interests or those of another party, provided those interests are not overridden by your rights and interests.

Our legitimate interests may include:

  • identifying professionals who may be suitable for employment or project opportunities;

  • providing recruitment and talent-sourcing services;

  • connecting candidates with organisations seeking talent;

  • maintaining appropriate candidate and professional networks;

  • maintaining relationships with candidates and clients;

  • developing our recruitment business;

  • protecting and improving our systems and services; and

  • operating AceSuited efficiently and securely.

Where we rely upon legitimate interests, we consider the nature and purpose of the processing and its potential impact on individuals.

Legal obligation
We may process information where necessary to comply with a legal or regulatory obligation.

Consent
Where applicable law requires consent for particular processing, we will request it. Where processing is based on consent, you may withdraw that consent at any time.

Withdrawal of consent does not affect the lawfulness of processing carried out before consent was withdrawn.

Additional legal conditions will be relied upon where required for processing special-category personal data.

5. Candidate Introductions and Sharing Information

As a recruitment business, it is necessary in certain circumstances for us to share candidate information with third parties involved in recruitment.

We may share relevant personal information with:

  • prospective employers and clients;

  • organisations offering relevant roles or projects;

  • recruitment partners involved in an opportunity;

  • service providers supporting our recruitment operations;

  • professional advisers, including legal or accounting advisers;

  • regulatory, governmental or law-enforcement authorities where required by law; and

  • other parties where disclosure is legally required or reasonably necessary to protect our legal rights.

We will not ordinarily submit your CV or detailed candidate profile to a prospective employer or client without first establishing your interest in the relevant opportunity.

Information disclosed to prospective employers or clients should be limited to information reasonably relevant to the recruitment process.

Sale, merger or restructuring of AceSuited

We may disclose or transfer personal information in connection with an actual or proposed merger, acquisition, investment, financing, restructuring, sale of AceSuited, sale of some or all of its business or assets, or similar corporate transaction.

Any such disclosure or transfer will be handled in accordance with applicable data-protection law.

AceSuited does not sell personal information as a product or for unrelated third-party commercial use.

6. Recruitment Systems and Service Providers

We use third-party technology and service providers to operate AceSuited and deliver our recruitment services.

These may include providers of:

  • recruitment and applicant-tracking systems;

  • customer relationship management systems;

  • website hosting and website functionality;

  • email and business communications;

  • cloud storage and document management;

  • professional networking and candidate-sourcing platforms;

  • job boards and recruitment marketplaces;

  • analytics;

  • automation and integration services;

  • security and IT services; and

  • AI-assisted business and recruitment tools.

These services may include providers such as Zoho, Squarespace, Google Workspace and LinkedIn, together with other recruitment, sourcing and technology platforms used by AceSuited from time to time.

Depending upon the service and circumstances, those organisations may process personal information on our behalf as processors or may act as separate data controllers under their own privacy terms.

Where required, we put appropriate arrangements in place with service providers processing personal information on our behalf.

7. International Data Transfers

AceSuited may work with candidates, clients, recruitment partners and technology providers located in different countries.

Personal information may therefore be transferred to, stored in, or accessed from countries outside the United Kingdom.

Where a transfer is subject to UK data-protection law and the destination is not covered by applicable UK adequacy regulations, we will use an appropriate lawful transfer mechanism where required.

Depending upon the circumstances, this may include the UK International Data Transfer Agreement, the UK Addendum to approved Standard Contractual Clauses, another legally recognised safeguard, or another mechanism permitted under applicable data-protection law.

Where appropriate, additional technical, contractual or organisational measures may also be implemented.

You may contact us if you would like further information concerning safeguards relevant to the transfer of your personal information.

8. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including recruitment, candidate relationship management, client services, legal, accounting, dispute-resolution and regulatory purposes.

Recruitment relationships often continue beyond a single vacancy. We may therefore retain candidate information within our candidate database so that we can consider and contact individuals regarding suitable future opportunities.

The period for which information is retained may depend upon factors including:

  • the nature of our relationship with you;

  • whether you remain potentially relevant for future recruitment opportunities;

  • the nature and sensitivity of the information;

  • the purposes for which it is held;

  • legal, contractual or regulatory requirements;

  • potential or actual disputes or legal claims; and

  • whether continued retention is reasonably necessary for legitimate recruitment purposes.

We periodically review information we hold and may delete, anonymise, archive, correct or update information where appropriate.

You may contact us to request deletion or correction of information we hold about you. Such requests will be considered in accordance with applicable data-protection law.

9. Marketing and Recruitment Communications

We may contact candidates and prospective candidates about employment, contract or project opportunities that we reasonably believe may be relevant to their professional experience or interests.

We may also communicate with clients and prospective clients regarding recruitment services and related business matters where permitted by law.

Where a communication constitutes direct marketing, we will comply with applicable electronic-marketing and data-protection requirements. Where consent is legally required, we will obtain the appropriate consent before sending the communication.

You may ask us to stop sending marketing communications at any time or use an unsubscribe mechanism where one is provided.

Opting out of marketing communications does not necessarily prevent us from contacting you concerning:

  • an application you have made;

  • a recruitment process in which you are participating;

  • an existing candidate or client relationship;

  • administrative or service communications;

  • legal or regulatory matters; or

  • another communication that does not constitute direct marketing.

10. Your Data Protection Rights

Depending upon the applicable law and circumstances, you may have the right to:

  • request access to personal information we hold about you;

  • request correction of inaccurate or incomplete information;

  • request deletion of your personal information;

  • request restriction of processing;

  • object to certain processing;

  • request portability of certain personal information;

  • withdraw consent where processing is based upon consent; and

  • raise a complaint with the relevant data-protection authority.

Some rights are subject to legal conditions and exceptions and therefore may not apply in every circumstance.

Right to object

Where we process your personal information on the basis of legitimate interests, you have the right to object to that processing in circumstances provided by data-protection law.

You also have the right to object at any time to processing of your personal information for direct-marketing purposes.

To exercise any applicable right, please contact us using the details at the end of this policy.

We may need to verify your identity before fulfilling certain requests.

11. Cookies and Website Analytics

Our website may use cookies and similar technologies.

Some cookies may be necessary for the operation, functionality or security of the website. Other technologies may be used for analytics or additional functionality.

Where applicable law requires consent before non-essential cookies or similar technologies are used, they will only be activated in accordance with the choices made through our cookie controls.

You can review or change available cookie preferences using the cookie controls provided on our website.

12. Security

We take appropriate technical and organisational measures designed to protect personal information against accidental or unlawful destruction, loss, alteration, unauthorised disclosure, misuse or unauthorised access.

Measures may include appropriate access controls, account security, reputable cloud and technology providers and organisational procedures relating to the handling of personal information.

Access to candidate and client information should be limited to individuals and service providers who reasonably require access for legitimate business purposes.

However, no method of electronic storage, transmission or processing is completely secure and we cannot guarantee absolute security.

13. AI and Automated Processing

AceSuited may use artificial intelligence, automation and other technology-assisted tools to support aspects of its operations, including:

  • candidate sourcing;

  • recruitment research;

  • organisation and administration;

  • candidate and vacancy matching;

  • search and filtering;

  • communications assistance; and

  • analysis of recruitment information.

Such tools are intended to support our recruitment activities rather than replace appropriate human judgement.

AceSuited does not currently make decisions that produce legal or similarly significant effects on individuals solely by automated processing without appropriate human involvement.

If our use of automated decision-making materially changes, we will update our practices and this Privacy Policy where required.

14. Third-Party Websites and Platforms

Our website or communications may contain links to third-party websites, job boards, professional networks or other services.

Those organisations may collect and process personal information independently of AceSuited and operate according to their own privacy policies.

AceSuited is not responsible for the privacy practices of independent third-party websites or services.

We encourage you to review the privacy information provided by relevant third parties when using their services.

15. Children

AceSuited's services are primarily intended for individuals seeking or being considered for professional employment or project opportunities and for organisations seeking talent.

We do not knowingly seek to collect personal information from children where there is no legitimate recruitment or legal reason to do so.

If you believe that information concerning a child has been provided to us inappropriately, please contact us.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to:

  • our business or recruitment services;

  • the technology and service providers we use;

  • the jurisdictions in which we operate;

  • our processing activities; or

  • applicable legal and regulatory requirements.

The current version will be published on this page and the “Last updated” date will be amended accordingly.
